NOTICE OF A HEARING ON PROPOSED RATES AND CHARGES Users of the City of Rushville's sewer utility, owners of property served or to be served by the City's sewer system, and other interested persons are hereby notified that Ordinance No. 2016-21 was introduced at a meeting of the City Council held on October 18, 2016 at 6:00 p.m. This Ordinance, if finally adopted, will adopt rates and charges for services applicable to the utility (as described in the below Ordinance). At a meeting of the City Council to be held on November 1, 2016 at 6:00 p.m. at the Council Chambers, 270 W. 15th Street, Rushville, IN 46173, there will be a public hearing on the matter of such rates and charges, and consideration of final adoption of said Ordinance. At such hearing and prior to final adoption of said Ordinance, all interested persons may appear and be heard. A copy of said Ordinance may be examined in the office of the City's Clerk Treasurer, which reads as follows: ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF RUSHVILLE 2016-21 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF RUSHVILLE, AMENDING TITLE V OF THE CITY OF RUSHVILLE, INDIANA, BASIC CODE OF ORDINANCES, PROVIDING A NEW SCHEDULE OF RATES AND CHARGES TO BE COLLECTED BY THE CITY OF RUSHVILLE FROM THE OWNERS OF PROPERTY SERVED BY THE SEWAGE WORKS OF THE CITY OF RUSHVILLE BE IT ORDAINED by the Common Council, City of Rushville, Indiana, that: WHEREAS, the Common Council of the City of Rushville, Indiana has heretofore enacted Title V., Section ^53.36, Sewer Rates of its Code of Ordinances, which Chapter relates to the waste water utility (sewage works) of the City of Rushville, Indiana; and WHEREAS, such Chapter provides for and establishes a schedule of rates and charges for the use of and the service rendered by the City's sewage works of the City of Rushville, Indiana; and WHEREAS, the revenues from the existing sewage treatment rates and charges are insufficient to pay costs associated with the Agreed Order previously executed with the Indiana Department of Environmental Management, operating expenses, to pay principal and interest on the revenue bonds, and make necessary additions and improvements to the system; and WHEREAS, the Common Council of the City of Rushville, Indiana, now finds that the rates and charges should be increased; NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RUSHVILLE, INDIANA: Title V, Section ^53.36 Sewer Rates and any other sections similarly affected, be amended as follows: B. The water usage on which the amount sewage rates and charges shall be determined and the rates and charges shall be as follows: Metered Rates (per 100 cubic feet) Proposed Rates First 350 cubic feet $ 10.15 Next 1,650 cubic feet $ 9.86 Next 4,000 cubic feet $ 8.52 Next 7,000 cubic feet $ 7.20 Next 12,000 cubic feet $ 5.32 Over 25,000 cubic feet $ 4.01 Minimum Monthly Charges 5/8 Inch Meter $ 35.53 3 Inch Meter $ 470.56 1 Inch Meter $ 67.12 4 Inch Meter $ 796.10 1^ Inch Meter $ 145.02 6 Inch Meter $ 1,882.22 2 Inch Meter $ 217.23 Unmetered Monthly User Rate Any unmetered user (Approx. 710 Cubic Feet) $ 70.97 Excess Strength Surcharge Rates Surcharge for Exceeding Pollution Concentration Limits -Biochemical Oxygen Demand (Per Pound) $ 0.124 (Concentration Limit 300 mg/l) -Total Suspended Solids (Per Pound) $ 0.086 (Concentration Limit 300 mg/l) C. Residential users who do not have a metered municipal supply of water shall be charged a flat price of $70.97 per month. E. In the event two (2) or more dwelling units such as mobile homes, apartments or housekeeping rooms discharging sanitary sewage, water or other liquids into the City's sanitary sewer systems, either directly or indirectly, are users of water and the quantity of water is measured by a single water meter, then in such case billing shall be for a single service in the manner set out elsewhere herein, except that the minimum bill shall not be less than the number of such dwelling units times $26.33 per month. In the case of mobile home courts the number of dwelling units shall be computed and interpreted as the total number of mobile homes located and installed in said court plus any other dwelling units served through the meter. A dwelling unit shall be interpreted as a room or rooms or any other space or spaces in which cooking facilities are provided. Extra Charges. Extra charges based on the strength of the sewage and liquid wastes shall be made on the following basis: Rate Surcharge Based Upon Suspended Solids There shall be an additional charge of $0.86 per cubic feet of flow each 300 milligrams, or fraction thereof, of suspended solids in excess of 300 milligrams per liter of fluid. Rate Surcharge Based Upon BOD There shall be an additional charge of $0.124 per 100 cubic feet of flow for each 100 milligrams, or fraction thereof, of biochemical oxygen demand in excess of 300 milligrams per liter of fluid. To determine the strength of the sewage and wastes, samplings and analysis shall be made from time to time whenever it is deemed desirable by the City of Rushville. After charges have been established based upon the strength of sewage and wastes, the owner may request reconsideration of these charges by the City by submitting analysis of composite samples of the sewage and wastes subject to such charges, certified by a Registered Engineer or a qualified graduate chemist. The City may then adjust the charges to the ordinance rates required by such analysis or may recheck the findings by additional samplings and analysis. Requests for rate adjustments by the owner may be submitted no more than once every twelve (l2) months. The determination of Suspended Solids and Five-day Bio-chemical Oxygen Demand contained in the waste shall be in accordance with the latest copy of Standard Methods for the Examination of Water, Sewage and Industrial Wastes as written by the American Public Health Association, the American Water Works Association and the Water Pollution Control Federation. A. Except for billings to multiple users such as apartment houses, mobile home courts and housekeeping rooms, the rates and charges may be billed to the tenant or tenants occupying the properties served unless otherwise requested in writing by the owners, but such billings shall in no way relieve the owner from liability in the event payment is not made as herein required. The owners of the properties served which are occupied by tenants shall have the right to examine the collections records of the City for the purpose of determining whether such rates and charges have been paid by such tenants, provided that such examinations shall be made at the office at which said records are kept and during the hours that such office is kept open for business. B. All ordinances and parts of ordinances in conflict herewith are hereby repealed. C. All fees and charges of the Utilities Service Board are subject to changes by the Utility Service Board as is necessary based upon the cost of providing said services. D. That all rates will become effective upon passage and Utilities implementation of month's charges on monthly invoices. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Rushville that the above Ordinance is hereby approved. DULY APPROVED this ____ day of _________________, 2016. Ann L.
