NOTICE OF A HEARING ON PROPOSED RATES AND CHARGES Users of the City of Rushville's municipal waterworks, owners of property served or to be served by the City's waterworks system, and other interested persons are hereby notified that Ordinance No. 2016-20 was introduced at a meeting of the City Council held on October 18, 2016 at 6:00 p.m. This Ordinance, if finally adopted, will adopt rates and charges for services applicable to the utility (as described in the below Ordinance). At a meeting of the City Council to be held on November 1, 2016 at 6:00 p.m. at the Council Chambers, 270 W. 15th Street, Rushville, IN 46173, there will be a public hearing on the matter of such rates and charges, and consideration of final adoption of said Ordinance. At such hearing and prior to final adoption of said Ordinance, all interested persons may appear and be heard. A copy of said Ordinance may be examined in the office of the City's Clerk Treasurer, which reads as follows: ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF RUSHVILLE 2016-20 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF RUSHVILLE, AMENDING CHAPTER 13 OF THE MUNICIPAL CODE OF THE CITY OF RUSHVILLE, INDIANA, ESTABLISHING RATES AND CHARGES FOR THE USE OF AND SERVICES RENDERED BY THE WATERWORKS SYSTEM OF THE CITY OF RUSHVILLE, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH. BE IT ORDAINED by the Common Council, City of Rushville, Indiana, that: WHEREAS, the Common Council of the City of Rushville, Indiana (the City), has heretofore enacted Title V., Section ^52.17 Water Rates and Charges of its Code of Ordinances which relates to the Water Works of the City of Rushville, Indiana; and WHEREAS, such Chapter provides for and establishes a schedule of rates and charges for the use of and the service rendered by the City's water works of the City of Rushville, Indiana; and WHEREAS, the revenues from the existing water rates and charges are insufficient to pay costs associated with services provided by the waterworks of the City and do not produce sufficient revenue to: (a) Pay all the legal and other necessary expenses incident to the operation of the utility, including costs associated with the Agreed Order previously executed with the Indiana Department of Environmental Management, maintenance costs, operating charges, upkeep, repairs, depreciation, and interest charges on bonds or other obligations, including leases; (b) Provide a sinking fund for the liquidation of bonds or other evidences or indebtedness; (c) Provide a debt service reserve for bonds or other obligations, including leases, in an amount established by the municipality, not to exceed the maximum annual debt service on the bonds or obligations or the maximum annual lease rentals; (d) Provide adequate money for working capital; (e) Provide adequate money for making extensions, replacements and improvements to the extent not provided for through depreciation; (f) Provide money for payment of any taxes that may be assessed against the utility; (g) Provide a reasonable return on the utility plant; (h) Compensate the city for taxes that would be due the City on the utility property were it privately owned; (i) It is the intent of this section that the rates and charges produce an income sufficient to maintain the utility property in a sound physical and financial condition to render adequate and efficient service. WHEREAS, pursuant to I.C. 8-1.5-3-8, the Common Council finds and elects that the water rates charged to users of the system shall be sufficient to compensate the City for taxes that would be due the City on the utility property were it privately owned; NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RUSHVILLE, INDIANA: That the Ordinance of the City of Rushville, establishing rates and charges for the use of and services rendered by the waterworks system of the City of Rushville, be amended as follows: Title V. Section ^52.17 Water Rates and Charges. There shall be and hereby are established for the use of and the service rendered by the waterworks system of the City of Rushville the following rates and charges based on the use of water supplied by said waterworks system: The monthly fire protection charges are in addition to any charges computed using the metered rates or the minimum monthly charges. SECTION 2. Except for the foregoing amendments, the remaining sections of Chapter 13 of the Municipal Code of the City of Rushville shall remain in full force and effect. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. The City Water Department has opted out of the Indiana Utility Regulatory Commission jurisdiction. SECTION 4. All fees and charges of the Utilities Service Board are subject to changes by the Utility Service Board as is necessary based upon the cost of providing said services. SECTION 5. This Ordinance shall become effective upon passage and Utilities implementation of month's charges on monthly invoices. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Rushville that the above Ordinance is hereby approved. DULY APPROVED this ____ day of _________________, 2016. Ann L.
